HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.9190 of 2009 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondent to call for the tender dated 24.04.2009, without cancelling the existing petitioner's contract vide Lr.Nil of 2008 dated 27.03.2008 for the period of 01.04.2008 to 30.03.2011 in respect of supplying of vessels and Shamiyana equipment to Kalyanamandapams in the premises of Sri Ramanama Sankeerthana Sangam, Ramnagar, Vijayawada as illegal and arbitrary and consequently to set aside the same.

2. Heard Sri G.V.N.R.s.S.S.Vara Prasad, learned counsel for the petitioner and Smt. K.Lalitha, learned Standing Counsel for the respondent temple.

This Court while admitting the writ petition on 29.04.2009, granted interim order suspending the impugned tender notification dated 24.04.2009.

4. Admittedly, the leasehold rights were issued in favour of the petitioner from 01.04.2008 to 30.03.2011. The grievance of the petitioner is that without cancelling the existing contract in his favour, the respondent temple arbitrarily issued impugned tender notification dated 24.04.2009. However, the contract in favour of the petitioner expired by 30.03.2011. By virtue of the interim order dated 29.04.2009 granted in W.P.M.P.No.12043 of 2009, the grievance of the petitioner is redressed. Moreover, by efflux of time, the cause in the writ petition does not survive for consideration, since the impugned tender notification was issued only for a period of one year.

Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel thereto,

miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
