HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18397 of 2016 ORDER:

This writ petition is filed seeking issuance of Mandamus declaring the action of the 2nd respondent in not giving the specifications for installation of required hardware (computer, printer and scanner) and the consequential action of respondent Nos.7 to 9 in threatening to stop the supplies, as illegal and arbitrary and consequently sought a direction to the 2nd respondent to give the specifications.

This Court by order dated 10.06.2016 directed the respondents to comply with the indent, if any, made by the petitioners for supply of liquor, if they satisfy all other requirements.

Today, when the matter is taken up for hearing, the learned Government Pleader for Prohibition and Excise (Telangana) placed on record a copy of the letter dated 14.06.2016 addressed by the Prohibition and Excise Superintendent, Hyderabad, to the Commissioner of Prohibition and Excise, Telangana State, Hyderabad, giving specifications of hardware requirement for Retail Vendors for HPFS Project.

Learned counsel for the petitioners submits that since the said information is furnished only on 14.06.2016, reasonable time may be given to the petitioners to comply

with the said requirements.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioners to purchase the required hardware for implementation of HPFS Project within a period of two weeks from today and intimate the same to the respondents. On such intimation being received, the respondents shall forthwith install the same as per the provisions of the Telangana Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2012 and also the provisions of the A.P. Excise Act, 1968. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
