O R D E R

Petitioner prays for Mandamus declaring the inaction of respondents 1 and 2 in investigating FIR No.28 of 2008 dated 10.04.2008 on the file of Police Station K.Gangavaram Mandal, East Godavari District, in accordance with law and filing charge sheet, as illegal and arbitrary. The learned Assistant Government Pleader for Home basing on written instructions dated 22.04.2013 submits that final report was filed before the Hon'ble Additional Judicial First Class Magistrate, Ramachandrapuram, by concluding that no cognisable offence is made out. Since final report is already filed, this court is of the view that the inaction complained in the writ petition, is untenable. Writ prayer is rejected.

However, petitioner is given liberty to work out the remedies against the final report filed in this behalf.
