HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION Nos.7224 & 9483 of 2017 COMMON ORDER:
Heard learned counsel for the petitioner/accused respectively of crime Nos.75 & 370 of 2017, which are outcome of the 2 reports of the 1st respondent-defacto complainant. The crime registered originally as crime No.370/2017 for the offences punishable under Sections 376 and 323 IPC on 21.07.2017 by Mancherial Town Police Station and the same pursuant to the direction of the Office of Commissioner of Police, Ramagundam, on 26.07.2017 was transferred to Nennel Police Station, who reregistered the crime as crime No.75/2017 for the selfsame Sections.
This Court on 23.08.2017 in Crl.P.No.7224 of 2017 covered by crime No.370 of 2017 while granting interim stay of not to arrest of the petitioner for 6 weeks, ordered notice to the 1st respondent and proof of service filed. The online track record of India post, the registered cover is delivered on 16.09.2017 to the Branch office Perkapally and the petitioner claims that the residence of the 1st respondent at Gundla Somaram is within the branch post office of Perkapally village to Nennel Mandal, Mancherial District for recording the same as taken as heard the 1st respondent and also learned Public Prosecutor representing the State and also learned counsel for the petitioner in both the matters in continuation to the earlier hearing covered by the interim order dated 23.08.2017.
Having regard to the above, the Criminal Petition is disposed of by confirming the interim order for nothing to interdict the
Dr.SSRB,J investigation, however pending investigation the petitioner shall not be arrested, it will not prevent the police for securing the presence of the petitioner for the purpose of investigation covered by crime No.75 of 2017, Nennel Police Station.
