The petitioners are members of the fifth respondent Society. When a notification was issued for conducting elections of the fifth respondent Society on 08.08.2017, they were elected as members of the Executive Body on 21.08.2017. When the election of the office bearers was to take place on 22.08.2017, the fourth respondent passed an order postponing the election on the ground that he received a communication on the same day from the second respondent.

A reading of the communication of the second respondent does not indicate any pending case in respect of the fifth respondent Society, but it merely states that a representation was received from some voters stating that they are eligible to be included in the voters list, but they were not allowed to participate in the elections. This is not one of the grounds for postponing the elections, after the election process was almost completed. Now the election process is at the stage of electing the office bearers.

In the circumstances, the impugned order of the fourth respondent dated 22.08.2017 is set aside and he is directed to conduct elections to the office bearers of the Society immediately after receipt of a copy of this order by duly intimating to the elected members of the executive body. The Writ Petition is, accordingly, allowed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
