HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.35264 OF 2016 ORDER:
This writ petition is filed questioning the inaction of the respondents, on the complaints made by the petitioner on 01.09.2016 and 27.08.2016, with regard to the illegal constructions in the park area in L.P.No.11/1997 in Juttada Village, Pendurthi Mandal.
It is the case of the petitioner that he along with others, after obtaining necessary permissions from the 2nd Respondent, got developed the land an extent of Ac.18-14 cents, situated in Pulagalapalem Village, Juttada Gram Panchayat, by leaving an extent of Ac.1-84 cents of land as open space area. It is further submitted that due to rapid growth of Visakhapatnam some unknown persons came along with building material and started constructions in the said open space, therefore, they made a complaint to the 3rd respondent on 27.08.2016. Since the 3rd respondent failed to take any action, they made complaints to the 2nd respondent and to the District Collector on 01.09.2016 and 03.10.2016 respectively, but so far no action has been taken. Hence, the present writ petition.
Heard the learned counsel for the petitioner, learned Government Pleaders for Municipal Administration (AP) and Home (AP), and Sri P. Jagadish Chandra Prasad, learned Standing Counsel for VUDA.
Having regard to the facts and circumstances of the case and especially considering the innocuous prayer of the petitioner, I deem it appropriate to dispose of the writ petition, without
expressing any opinion, directing the respondent authorities to consider the complaints dated 27.08.2016 and 01.09.2016 made by the petitioner, within a period of four weeks from the date of receipt of this order and pass appropriate orders in accordance with law.
With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions, if any pending in this writ petition shall stand closed.
