THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 14421 of 2014 Order:
This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioner/A2, seeking to quash the proceedings pending against him in Crime No. 186 of 2013-2014 of Excise Police Station, Narsapur, Medak District.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.
3. The allegations, in brief, are that on the date of incident the excise officials raided the illegal toddy depot at Domadugu and seized two wooden tubs containing 300 litres of toddy in each tub and also 25 wooden cases containing in each case 24 bottles of toddy. It is alleged that on interrogation, the non-petitioner-A1, who is present there at the time of raid, disclosed that the petitioner/A2 is the Supervisor of the said depot. Taking into consideration the nature of allegations and the averments made in the FIR, I do not think it proper to quash the proceedings against the petitioner/A2. The Criminal Petition is devoid of merit and the same is liable to be dismissed.
4. Accordingly, the Criminal Petition is dismissed.
5. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed. __________________ M.S.K. JAISWAL, J.
