THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1408 OF 2017 ORDER:

Heard Sri Praveen Kumar Veerjala, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Telangana.

2. Learned counsel for the petitioner, though, initially, sought for granting interim custody of 360 Kgs. of Black Jaggery on furnishing personal bond in connection with P.R.No.386 of 2016, dated 05.12.2016, of Station House Officer, Prohibition and Excise, Nirmal, Nirmal District, but, however, restricted the request to the extent of directing respondent No.2 - Deputy Commissioner, Prohibition and Excise, Nirmal, Nirmal District, to dispose of the representation, dated 26.12.2016, made by the petitioner, a copy of the said representation is filed in the material papers, wherein he made a request to the Deputy Commissioner for interim custody of 360 Kgs. of Jaggery stating that he has secured an order in W.P.No.20234 of 1999 in respect of sale of Jaggery.

3. When the representation, dated 26.12.2016, is pending with respondent No.2, it is desirable to direct respondent No.2 to dispose of the representation in accordance with law.

4. Accordingly, the Criminal Petition is disposed of directing respondent No.2 to dispose of the representation, dated 26.12.2016, of

the petitioner in accordance with law as expeditiously as possible, preferably not later than a month from the date of receipt of a copy of this order.

5. Miscellaneous Petitions pending, if any, in this Criminal Petition, shall stand closed.
