HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.28379 OF 2014 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the respondents in contemplating to assign any portion of watercourse Poramboke land (Vagu) situated adjacent to the petitioner's land admeasuring Ac.1.43 cents covered by survey No.217/1 of Thotapalli Revenue Village, Agiripalli Mandal, Krishna District, without protecting the same for public purpose, as illegal and arbitrary.
Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the application submitted by the petitioner on 21.07.2014.
Learned AGP would submit that the 5th respondent may be directed to dispose of the application submitted by the petitioner, in accordance with law.
Having considered the rival submissions made, the writ petition is disposed of directing the 5th respondent-Village Revenue Officer, Thotapalli Village, Agiripalli Mandal, Krishna District, to
deal with the representation submitted by the petitioner on 21.07.2014, in accordance with law, after hearing the petitioner and other aggrieved persons, if any. If such representation is not available in the office of the 5th respondent, the petitioner shall furnish a copy of representation to the 5th respondent, in which event, the same shall be dealt with in accordance with law. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
