ORDER
Challenging the action of the 2nd respondent in not registering the complaint dated 21.10.2016 of the petitioner, the present writ petition is filed.
Based on the written instructions, learned Government Pleader for Home submits that the complaint as alleged was not received by the 2nd respondent.
In view of the authoritative pronouncement of the judgment of the Apex Court in Lalita Kumari v. State of Uttar Pradesh & Ors1, it is incumbent upon the 2nd respondent to register the complaint whenever cognizable offence is made out.
Since the 2nd respondent stated that no complaint was received, it is for the petitioner to approach the 2nd respondent and lodge a complaint, for which purpose, liberty is given to him. Accordingly, the Writ Petition is disposed of. No costs.
