HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19791 OF 2016 ORDER:

The case of the petitioner is that he is the owner and possessor of the house bearing D.No.2-309, Undavalli Village, Tadepalli Mandal, Guntur District which is the ancestral property of the petitioner and the petitioner is residing in the said house and his name is also mutated in the Revenue Records and he got electricity service connection to the said house and paying electricity charges and house tax regularly. While so, the 2nd and 3rd respondents came to the said house on 25.05.2016 and noted down the measurements of the structures stating that they would evict the petitioner from the said property. Thereafter, on 06.06.2016, the respondents again came to the said locality and directed the petitioner and others to vacate the premises. Aggrieved by the same, some of the residents of the said locality have filed WP.No.17982 of 2016, wherein this Court granted Status quo on 09.06.2016. But, however the respondent authorities are trying to demolish the subject property without issuing any notice or following any procedure. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Sri Ravi Cheemalapati, learned counsel appearing for the 3rd respondent on instructions submits that the 3rd respondent will not evict the petitioner from the subject property, without following due process of law. In view of the above facts and circumstances, the writ petition is disposed of directing the respondents not to evict the petitioner from the subject property, without following due process of law. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
