THE HONOURABLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION NO. 4470 OF 2022 O R D E R:
This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners/Accused Nos.1 and 3 on bail in connection with Crime No.115 of 2022 on the file of Kalluru Police Station, Khammam District, registered for the offence punishable under Section 306 read with 34 of Indian Penal Code. 2.
The prosecution case, in brief, is that on 29.04.2022, the petitioners/ accused Nos.1 and 3 along with other accused picked up a quarrel regarding pathway and alleged to have scolded the wife of the complainant in filthy language and uttered words 'you should die to our talks'. Thereby, she committed suicide. 3.
Learned counsel for the petitioners denied the accusations made against the petitioners/Accused Nos.1 and 3 and pleaded innocence. Further submits that as per their information, the deceased had some medical issues and the petitioners are no way concerned with her suicide. Further, except omnibus allegations, no
specific overt act was attributed against any of the petitioners. Thus, prayed for grant of bail.

Learned Assistant Public Prosecutor opposed the petition and submits that the investigation is still pending and the complaint averments are revealing the involvement and abatement by the petitioners/ accused Nos.1 and 3 qualifying the accusations. 5.
I have perused the record. Having regard to the nature of offence and the allegations made against the petitioners/ accused Nos.1 and 3 and considering the depth of outlining active role in facilitating or purported instigation, I am inclined to grant bail to the petitioners/ accused Nos.1 and 3 subject to the following conditions. i) The petitioners/ accused Nos.1 and 3 are directed to be released on bail on executing personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of Family Court-cum-VI Additional Sessions Judge, Khammam.
2) The petitioners/ Accused Nos.1 and 3 shall furnish the address and contact particulars and the changes, if any, from time to time to the SHO, Kalluru PS, till final disposal of the case.
3) The petitioners/accused Nos.1 and 3 shall be available for interrogation as and when required by the investigating agency till filing of the final report.
4) The petitioners/accused Nos.1 and 3 shall not cause or intimidate the prosecution witnesses or shall in anyway tamper with the evidence of the prosecution case. 6.
