THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4473 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of Cr.P.C., seeking pre-arrest bail to the petitioners/Accused Nos.2, 4 to 6 in the event of their arrest in connection with Crime No.115 of 2022 on the file of Kalloor Police Station, Khammam District, registered for the offence punishable under Section 306 read with 34 of I.P.C.. 2.
It is alleged that on 29.04.2022 these petitioners and also Accused Nos.1 and 3 entered into the house of the deceased and abused her while she was alone in the house. The de facto complainant, who is husband of the deceased, was informed about the trespassing of these petitioners and two others and their assault and oral abuse. Thereafter, the deceased committed suicide on the same day, for which reason, the present complaint was filed by her husband alleging that all the accused Nos.1 to 6 are responsible for his wife's death and the death was a result of the assault and oral abuse by all the accused Nos.1 to 6. Accused Nos.1 and 3 were already arrested and released on regular bail. In the complaint, there are no specific allegations against these petitioners except stating that they were part of the group of six persons, who trespassed into the house of the deceased and abused her.

In the said circumstances, this Court is inclined to grant Anticipatory Bail to the petitioners/Accused Nos.2, 4 to 6 on the following conditions:
1) The petitioners/Accused Nos.2, 4 to 6 are directed to surrender before the Station House Officer, Kalloor Police Station, Khammam District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/Accused Nos.2, 4 to 6 on bail, on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.2, 4 to 6 shall report before the said Station House Officer on every first and third Monday between 09.00 a.m. and 11.00 a.m., for a period of three months or till filing of the charge sheet, whichever is earlier.
3) The petitioners/Accused Nos.2, 4 to 6 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
