HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.8503 OF 2009 ORDER:

The relief sought for in this Writ Petition is to direct the respondents to consider the petitioners representation dated 24.03.2008 and to allot them land admeasuring Ac.0.07 cts in Sy. No.117/3 of Lingasamudram village, which they claim to be in their possession for the past 20 years, on payment of market value. In the counter-affidavit filed by the respondents, the petitioners claim of being in possession is denied. It is stated that the subject land is being used for the communal purpose of construction of a temple. The petitioners cannot claim, as of right, that the Government/Gram Panchayat land should be allotted to them at market value. The Writ Petition as filed is wholly misconceived, and is accordingly dismissed. The miscellaneous petitions pending, if any, shall stand closed.
