THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9447 of 2016 ORDER:

This Criminal Petition is filed by the petitioner, under Section 438 of the Criminal Procedure Code, seeking anticipatory bail in an un-numbered crime on the file of Narayanaguda Police Station, Hyderabad.

The case of the petitioner is that he is working as Senior Assistant in the office of the Commissioner, Endowments Department, Hyderabad. The Commissioner and the Deputy Commissioner have started harassing the petitioner without there being any reason and on 18.06.2016 when some unsocial elements started galata at the main gate of the office and the petitioner tried to pacify them. At that time, the Commissioner and the Deputy Commissioner, who entered into the office, noticed the same and made allegations against the petitioner that he shouted in unparliamentary language against the officers and the staff and issued suspension order to the petitioner and also informed that a complaint is also lodged against him. Learned Additional Public Prosecutor submitted that no case is registered against the petitioner in the above said police station and therefore, there is no apprehension of arrest of the petitioner. In view of the above submission of the learned Additional Public Prosecutor, this criminal petition is not maintainable and accordingly, the same is dismissed.
