HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14031 OF 2015 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioner-A.5 seeking anticipatory bail in connection with Crime No.169 of 2015 on the file of S.H.O., Srikakulam II Town Police Station, Srikakulam District registered for the offences under Sections 120-B, 420, 406, 511 r/w 34 IPC, 156(3) Cr.P.C., Section 168(2), 339(3) 447 and 448 of Companies Act, 2013. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The case of the prosecution is that A.2 and his family members and relatives started a finance company in the name of M/s.Suvarna Infraprojects India Limited at Amalapuram and collected huge amounts from the public and issued some bonds and thereafter absconded from that place.

Learned counsel for the petitioner submitted that the petitioner is nothing to do with the alleged offence and that he worked as an agent in the said company for a short period and thereafter, he resigned fro the said job and completed his higher studies and now he is working as a Lecturer.

Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner. Hence, the petitioner-A/5 is directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety for the likesum to the satisfaction of the Magistrate concerned. Further the first petitioner is directed to report before the Station House Officer concerned, daily between 10.00 a.m. and 5.00 p.m. for a period of fifteen days.
