HCJ & Dr.SA, J WP.No.17307 of 2019 Dt: 16.08.2019 ORDER: (per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) Mr. P. Vishal, the petitioner, has filed this Habeas Corpus Petition, ostensibly on the ground that his wife, Mrs. G. Maheshwari, has been taken away by his in-laws, the respondent Nos.3 to 5.

According to the petitioner, his wife is being kept under house arrest. Therefore, her detention is absolutely illegal. However, Mr. Santosh Kumar, the learned Government Pleader, informs this Court that the Sub Inspector of Police, Saifabad Police Station, has submitted a report, wherein it has been pointed out that on 05.11.2015, the detenue's brother, G.Nikhil, had informed the Police of Saifabad Police Station that his sister, G. Maheshwari, had committed suicide by hanging on 05.11.2015 at 11.30 hours. Subsequently, the body was recovered by the police and sent for post-mortem. According to the postmortem report, the detenue died by hanging. The case was treated as a 'suicidal death'. Hence, the detenue is no longer alive. As the reasons given by the learned Government Pleader have not been challenged by the learned counsel for the petitioner, this Habeas Corpus Petition no longer survives. It is hereby dismissed. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, shall also stand dismissed.
