This criminal petition is filed by accused No.5, under Section 438 of Cr.P.C., to grant pre arrest bail in Crime No.74 of 2016 on the file of the Station House Officer, Railway Kodur Police Station, Kadapa District.

At the time of hearing, the learned counsel for the petitioner seeks permission of the Court to permit the petitioner to withdraw the criminal petition with liberty to file a fresh petition. Permission is granted.

Accordingly, the criminal petition is dismissed as withdrawn.
