THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.908 of 2015 ORDER:

This writ petition filed under Article 226 of the Constitution of India, challenges the order issued by the office of the Executive Officer, Tirumala Tirupati Devasthanams-1st respondent vide proceedings Roc.No. DA4/3988/2013 dated 28.8.2014.

2. Heard Dr.P.B.Vijaya Kumar, learned counsel for the petitioner and Sri A.K.Jayaprakash Rao, learned Standing Counsel for respondents, apart from perusing the material available before the Court.

By virtue of the order impugned in the present writ petition, the 1st respondent imposed punishment, demoting the petitioner from the post of Coordinator, HDPP cadre to his original position as Program Assistant. Aggrieved by the said order of punishment, the petitioner herein preferred appeal before the 3rd respondent-Trust Board on 18.9.2014.

4. Though a number of contentions have been raised in the writ petition with regard to the sustainability of the impugned order, the fact remains that the appeal preferred by the petitioner dated 18.9.2014 against the order of punishment is pending consideration before the 3rd respondent. In view of pendency of the said appeal before the 3rd respondent, this Court is not inclined to grant relief as sought in the writ petition. But having regard to the facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if the 3rd respondent is directed to dispose of the appeal dated 18.9.2014 filed against the order of punishment dated 28.8.2014 by fixing some time frame.

5. For the aforesaid reasons, the writ petition is disposed of, directing the 3rd respondent herein to pass appropriate orders on the appeal dated

18.9.2014 preferred by the petitioner against the order of punishment dated 28.8.2014 within a period of three months from the date of receipt of this order, after giving notice and opportunity of being heard to the petitioner. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
