THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35848 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in registering the Crime No.667 of 2016, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that prior to 27.07.2016, some unknown persons under the caption of M/s. KCR Nagar Residential Association, in large numbers suddenly started construction of rooms rapidly in Survey No.215 to 224 of Papaiguda, Kuntloor Village, violating the directions of this Court issued in various writ petitions, which were filed by M/s. KCR Nagar Residential Welfare Association and that the 3rd respondent had taken steps and removed the unauthorised constructions being taken up with the help of the police on 21.07.2016 and that the activities of the petitioners are illegal. The main grievance of the petitioners is that the 2nd respondent is trying to arrest them.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.667 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
