HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.111 of 1999 JUDGMENT :
When the matter is called, there is no representation for the appellants/defendants.
2. In fact, when the matter came up on 02.11.2015, learned counsel for the respondent, who has represented the matter today also, reported that the sole respondent died in the year 2001 and even furnished the details of addresses of the legal representatives of the deceased - sole respondent, who are numbering 3, and a Memo to that effect was also filed. Inspite of the same, it appears that no steps were pursued in accordance with the relevant provisions under Order XXII Rule 10(A) of C.P.C.
3. Though, the death of the sole respondent occurred in 2001 and even the relevant information complying with the mandatory provisions under Order XXII Rule 10(A) of C.P.C., was also furnished on 02.11.2015, since no steps are taken to bring the legal representatives of the deceased - sole respondent on record, the present appeal stands dismissed as abated. No order as to costs.
4. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
