O R D E R
The grievance of the petitioner was that its recognition was withdrawn under the proceedings dated 12.06.2015 and the appeal filed against the said order on 13.07.2015 is not being disposed of. Taking note of the fact that the students of the petitioner institution would stand to suffer owing to the pendency of the appeal, by order dated 16.12.2015, this Court directed the Director of Government Examinations, Hyderabad, the seventh respondent, to receive examination fee from the petitioner institution without prejudice in accordance with the due procedure.
As the petitioner's appeal against the proceedings dated 12.06.2015 of the Regional Joint Director of School Education, Hyderabad, is yet to receive consideration by the Commissioner and Director of School Education, Hyderabad, the second respondent, this Court sees no purpose served in entertaining the present writ petition at this stage as the appellate authority has to consider the matter on merits in the first instance.
The writ petition is accordingly disposed of directing the appellate authority, the second respondent, to consider the petitioner's appeal in accordance with law and pass appropriate reasoned orders thereon. This exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
