HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.19851 of 2016 ORDER:

The petitioner is challenging the order dated 15-06-2016 passed by the 3rd respondent, wherein the document presented by the petitioner for registration was refused and rejected on the ground that the SubRegistrar is also a party in O.S.No.13 of 2016 on the file of Senior Civil Judge's Court, Rajampeta.

Learned counsel for the petitioner submits that no injunction is operating against the Sub-Registrar, Rajampeta in the said suit. In view of the same, refusing to receive the document for registration is erroneous. On earlier occasion, the matter was adjourned for instructions.

Heard learned Assistant Government Pleader for Revenue.

Since the impugned order does not indicate that any injunction order is operating against the Sub-Registrar. Mere pendency of suit does not disentitle him from entertaining the document for registration. In view of the same, the impugned order is set aside and the 3rd respondent-Sub-Registrar is directed to receive the document and register the same, if the same is in order as per the provisions of the Stamp Act and Registration Act.

If he wants to refuse to receive the same, he shall record reasons and pass appropriate order.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 23-09-2016 Nvl
