THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.17383 of 2019 ORDER:

This writ petition is filed under Article 226 of the Constitution of India to declare the action of the respondents in interfering with personal life, liberty and civil disputes of the petitioners in respect of the property viz., house municipal bearing No.8-15-32/22/4 in plot Nos.806 and 807 situated at Meer Sagar, Hamlet of Shastripuram Colony, Mailardevpally, Rajendranagar Mandal, Ranga Reddy District and threatening the petitioners with dire consequences to settle the civil disputes at police station, as illegal and arbitrary and consequently to direct the respondents not to interfere with the personal life, liberty and civil disputes of the petitioners with regard to subject property without following due procedure of law.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for the respondents.

On written instructions, learned Assistant Government Pleader for Home would submit that the present writ petition came to be filed by the petitioners while the police authorities were seeking to serve notices under Section 41 (A) of Criminal Procedure Code in connection with the Crime No.1017 of 2018 registered against them at Mailardevpally Police Station

for the offences punishable under Sections 447, 427, 468, 471 and 420 read with Section 34 of IPC, wherein they are arrayed as accused Nos.4, 5 and 6. He would also submit that the investigation in the said crime is at final stage and the presence of accused persons is very much required to conclude the investigation and thereafter, the charge sheet can be filed before the competent court.

The learned counsel for the petitioners would submit that upon service of summons on the petitioners in the above said crime, they would appear before the police authorities for completion of the investigation.

Recording the above said submissions made by both the parties, the writ petition is closed. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 30.09.2019 Isn
