THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4921 of 2019 ORDER :

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/Accused No.4 for grant of bail in Crime No.224 of 2019 of Vemulawada Town Police Station, Rajanna Sircilla District, registered for the offences punishable under Sections 302, 120-B and 109 read with 34 I.P.C.

Heard the learned counsel for the petitioner/accused No.4, the learned Additional Public Prosecutor representing the respondent/State and perused the record.

Learned counsel for the petitioner would submit that the allegations levelled against the petitioner are all false and created for the purpose of this case; that the petitioner never committed any offence and the alleged recovery confession panchanama is also false; that the petitioner is having two minor children; that all witnesses were examined, except filing of charge sheet and hence, he prays to grant bail to the petitioner. 4.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioner stating that the petitioner is the main conspirator in this case, where she hatched a plan along with other accused and committed murder of the deceased; that investigation is still pending and hence, he prays to dismiss the application.

As seen from the remand case diary, there is ample evidence to show that the petitioner along with other accused hatched a plan and at her instance only committed murder of the deceased in broad daylight. Thus, looking into the nature of allegations, gravity of offence and involvement of

the petitioner in the commission of offence, I am not inclined to grant bail to the petitioner. Hence, the criminal petition is liable to be dismissed. 6.
