This writ petition is filed seeking the following relief :- " ....... to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not recovering an amount of Rs.1,82,997/ - (rupees One Lakh eighty two thousand nine hundred and ninety seven) from the 5th respondent who drawn and utilized the same towards vehicle hire charges during her term in the year 2015-16 as the Commissioner of Metpally Municipal council, as recommended by the 4th respondent, as being illegal and arbitrary and consequently to direct the respondents to recover the same in a time bound manner and to initiate departmental proceedings against the 5th respondent for misusing the general funds of the Municipality....." .

In the instant case, admittedly, the petitioner does not have any interest in the public funds and being a citizen, he is trying to protect the public money. The prayer as sought for by the petitioner in the individual capacity cannot be granted and the proper remedy available for the petitioner is to file a PIL seeking appropriate relief.

Learned counsel for the petitioner, therefore, seeks permission of this Court to withdraw the present writ petition with a liberty to the petitioner to file a PIL seeking appropriate relief. Permission is accorded.

Accordingly, granting the aforesaid liberty to the petitioner, the writ petition is dismissed as withdrawn. No order as to costs. Miscellaneous petitions, if any pending, shall also stand dismissed.
