The Court made the following:

ORDER:

Alleging that the order passed by this Court in W.P.No.36267 of 2013 on 12.12.2013 was violated on the ground that even though the original acquisition

was only for 318.23 square yards, the respondents took possession of 419.00 square yards and compensation was paid only to 318.23 square yards.

2. Counter affidavit is filed. The specific allegation that possession of larger extent is taken than what was notified is denied. It is asserted that though the respondents are entitled to take possession of 318.23 square yards, which was acquired and compensation paid, physically only 305 square yards was taken possession and since the respondents are in need of additional extent i.e., totally 399.40 square yards of the petitioner's property, further requisition is placed on the Special Deputy Collector. As and when the process is completed, the possession for the rest of the extent of property would be taken.

3. Having regard to the same, the Contempt Case is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
