THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.15430 OF 2018 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the only grievance of the petitioner appears to be the seizure of the passport by the 5th respondent/police officer at Bangalore Airport on the arrival of the petitioner from Colombo, on 04.04.2018, in connection with a case in Crime No.42 of 2018 on the file of the Women Police Station, Begumpet. 2.

I have heard the submissions of Sri M.Prudhvi Raju, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for the respondents. Perused the material record.

At the hearing, it is undisputed that after the passport has been seized after due service of notice under Section 41-A of the Code of Criminal Procedure, the same was submitted to the Court of the learned XV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

In that view of the matter, the Writ Petition is disposed of reserving liberty to the petitioner to approach the Court of the said learned Magistrate and file an appropriate application in accordance with the procedure established by law for appropriate relief, which the law permits. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
