HON'BLE SRI JUSTICE C.V.BHASKAR REDDY CONTEMPT CASE No.1137 of 2018 O R D E R:

The W.P.No. 42214 of 2017 has been filed by the Welfare Association of Rain Tree Park (Malaysian Township) questioning inaction of the official respondents in taking action on the officers who failed to furnished the site plans said to have been approved along with the revised plans approved of petitioner's Association Integrated Community Project during the year 2007 as illegal, arbitrary and consequently direct respondent Nos.2 and 4 to conduct an enquiry to furnish the site plans and revised site plans to the petitioner's association and for other reliefs. 2.

This Court vide order dated 13.01.2018, directed the parties to maintain status quo existing on that date and directed the Registry to place all the connected writ petitions for hearing after obtaining necessary permissions from the Hon'ble the Acting Chief Justice. 3.

Now, the Contempt Case has been filed stating that during the pendency of the writ petition, the respondents have directed the petitioner association to remove the illegal constructions raised in Totlot/ Park area.

Mr. Dhananjay Reddy, learned Counsel appearing for the respondent-Corporation has submitted that they have issued notice dated 09.04.2018, in compliance of the orders issued by this court in W.P. No.31184 of 2017 for removal of illegal constructions raised in Park area. He submits that since the respondent-Corporation has acted to comply the orders passed by this court in another connected writ petition, the action of the respondents does not amount to willful disobedience of the orders of this Court.

Recording the submission of the learned Standing Counsel and since the main writ petition is pending, a liberty is given to the petitioner association to take appropriate action after disposal of the batch of writ petitions, in accordance with law.

With the above liberty, the present Contempt Case is closed as no further orders are necessary Miscellaneous petitions, if any pending in this contempt case shall stand closed.
