THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.16615 of 2016 ORDER:

The petitioner maintained the Writ Petition under Article 226 of the Constitution of India against the respondents 1 to 8 of whom 1st respondent is State of Telangana represented by the Principal Secretary, Home Department and respondents 2 and 3 are the Commissioner of Police, Hyderabad and Station House Officer, Medipally Police Station, Cyberabad and respondents 4 to 8 are the private persons.

2. The relief sought is to issue appropriate writ or order or direction particularly in the nature of Mandamus declaring the action of the respondents 1 to 3 in causing harassment and threats with regard to the civil disputes of respondents 4 and 5 as illegal and detriment to the fundamental rights of the petitioner, including to direct not to call him to the police station in connection with the civil dispute of respondents 4 and 5.

3. The written instructions received by the Government Pleader for Home and submitted is that the said allegations are false and they never called the petitioner much less asked to settle the civil disputes with the respondents 4 and 5 or 6 to 8, respectively,

Having regard to the above, the Writ Petition is disposed of by observing that if at all petitioner's requirement is necessary before the police for any crime to answer in relation to the disputes with respondents 4 to 8, he must be called by giving anything in writing in accordance with the due process of law. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending if any shall stand closed.
