THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17390 OF 2019 ORDER :

This writ petition is filed challenging inaction of the 3rd respondent, Station House Officer, in taking any legal action based on the complaint dated 04.07.2019 filed by the petitioner. Learned Assistant Government Pleader for Home produced a copy of the written instructions dt.22.08.2019 of the Sub Inspector of Police, Kusumanchi Police Station, Khammam District. To the extent of their relevance to the present writ petition, the said instructions read as under:

"It is submitted that on receipt of above complaint, GD entry was made and enquiry was done and during enquiry it was disclosed that already a case is pending in the Hon'ble Court in W.P. No.26428 of 2016 and also a EP was filed by the Puduri Bhushanam, who is actual owner of the above said land and it was pending before Hon'ble Jr. Civil Court, Khammam, further on enquiry it was disclosed that no such incident occurred on 5.8.2018 as stated by the petitioner.

It is submitted that after enquiry, the Station House Officer, Kusumanchi tried to inform the same to the petitioner, but he was not available at the address given by him in the complaint, that finally on 22.8.2019 a Notice was served on the petitioner informing that no case can be registered on his complaint as the matter is pending in the Hon'ble Court."

Recording the aforesaid submission of the learned Assistant Government Pleader for Home, this writ petition is disposed of leaving

it open to the petitioner to avail alternative remedy as available to him under law. There shall be no order as to costs. As a sequel, miscellaneous applications, if any pending, shall stand closed.
