THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.17393 of 2019 ORDER:

The present writ petition is filed to declare the action of the 3rd respondent-Station House Officer, Kusumanchi Police Station, Khammam, in not registering FIR and not taking any legal action, based on the complaint of the petitioner dated 22.12.2018, as illegal and arbitrary.

Heard Sri Ramesh Bura, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home, on written instructions of the 3rd respondent, dated 22.08.2019, which is placed on the record of this Court, would submit that on receipt of the complaint from the petitioner, an entry was made in the General Diary and enquiry was done. During the enquiry, it was disclosed that already a case is pending before this Court in Writ Petition No.26428 of 2016 and also an E.P. was filed by one Puduri Bhushanam, who is the actual owner of the said land and is pending before the Court of Junior Civil Judge, Khammam. On further enquiry, it disclosed that no such incident occurred on 05.08.2019 as being complained of. The 3rd respondent by notice dated 22.08.2019 informed the petitioner that no case can be registered on his complaint, as the matter is pending before

this Court and also the dispute is civil in nature and the same was served on the petitioner. He further submits that if the petitioner is aggrieved by the said report, he can approach appropriate forum to avail remedies in accordance with law. Recording the said submission made on behalf of the respondents, granting liberty to the petitioner to approach appropriate forum, no further orders are required to be passed in this writ petition.

Accordingly, the writ petition is closed. However, there shall be no order as to costs.
