THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 20840 of 2010 ORDER:

When the matter is called, none appeared for the petitioner. This Writ Petition is filed challenging the action of the respondent in not considering the representation of the petitioner dt. 07.03.2007 in connection with the appointment to the post of Counsellor in ART Centre of Government Hospital, Eluru.

A counter affidavit was filed stating that on the representation of the petitioner, the matter was enquired by the Superintendent of the Hospital, ART Centre and based on the report, the services of the incumbent were terminated and the said post was advertised as per NACO guidelines. The petitioner did not possess any experience in counselling in HIV/AIDS. The post of counsellor in ART Centre is a contractual post and the period of contract is for one year. In view of the consideration of the representation of the petitioner dt. 17.11.2010 and termination of the services of the incumbent, the cause in the Writ Petition does not survive for adjudication.

In view of the submissions made in the Counter Affidavit, no relief can be granted in the present Writ Petition.

With the above observation, the Writ Petition is dismissed. No order as to costs.

As a sequel, miscellaneous petitions, if any, pending in this case, shall stand closed.
