THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4456 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of Cr.P.C. seeking pre-arrest bail to the petitioners/Accused Nos.1 and 2 in the event of their arrest in connection with Crime No.298 of 2021 on the file of Pargi Police Station, Vikarabad District, registered for the offence punishable under Section 326 read with 34 of I.P.C.. 2.
The case of the prosecution is that on 01.10.2021 while the de facto complainant/victim was carrying Tiffin on the motor bike, he noticed his friend Aravind with bleeding injuries, as such, the de facto complainant took his friend to the hospital, however, while carrying his friend on the motor cycle, the petitioners allegedly stopped motor cycle and caused injuries to the de facto complainant also. Though the crime was initially registered for the offence under Section 324 read with 34 I.P.C., later, the provision of law was altered to Section 326 read with 34 I.P.C..

On instructions, the learned Assistant Public Prosecutor would submit that the alleged victims, de facto complainant and his friend were treated as out-patients.

In the said circumstances, this Court is inclined to grant Anticipatory Bail to the petitioners/Accused Nos.1 and 2 on the following conditions:
1) The petitioners/Accused Nos.1 and 2 are directed to surrender before the Station House Officer, Pargi Police Station, Vikarabad District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/Accused Nos.1 and 2 on bail, on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties in a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.1 and 2 shall report before the said Station House Officer on every Sunday between 09.00 a.m. and 11.00 a.m., for a period of three months or till filing of the charge sheet, whichever is earlier.
3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.
Accordingly, the criminal petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
