When the matter was taken up for hearing on 03.11.2017, as none appeared, it was directed to be listed under the caption 'for dismissal'. Thereafter, the matter was adjourned on four occasions. Even today, when the matter is taken up for hearing, neither the petitioners appear nor there is any representation on their behalf. Hence, the petition is taken up for disposal on merits. 2.
The criminal petition is filed for quash of the proceedings in CC.No.710 of 2008 on the file of the Judicial First Class Magistrate, Jagtial, Karimanagar District. The offences alleged are under Sections 16(1)(a)(i), 7(i) and 2(ia)(m) of the Prevention of Food Adulteration Act, 1954.

The sample was taken on 23.04.2002 from the Nescafe Sunrise packets, which is kept for human consumption. On 24.04.2002, the sample was sent to Public Analyst for analysis. The consent to launch prosecution against the petitioner was given on 04.11.2003. The counsel for the petitioners is absent and did not make any submissions as to how the petition is maintainable for quash of proceedings.
The criminal petition is dismissed. Interim stay, granted earlier in CRLPMP.No.3220 of 2011, stands vacated.
