HON'BLE SRI JUSTICE J. SREENIVAS RAO WRIT PETITION No.17328 of 2019 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare.

2. This writ petition is filed seeking writ of mandamus declaring the order passed by the respondent No.1 in Memo No.842/TW.LTR.2/2019 dated 20.07.2019 rejecting the stay application while admitting the revision petition filed by the petitioners under Section 6 of Telangana Scheduled Areas Land Transfer Regulation 1 of 1959 as illegal and arbitrary.

Learned counsel for the petitioner contended that the petitioner filed revision petition before the respondent No.1 aggrieved by the order passed by the respondent No.2 in CMA No.48 of 2011 dated 29.01.2019 confirming the order passed by respondent No.3 in LTR Case No.3/2011/SINGARENI and 19.08.2011.

He further contended that respondent No.1 while admitting the revision petition rejected the stay petition without giving any opportunity to the petitioner and passed impugned Memo No.842/TW.LTR.2/2019 dated 20.07.2019. By virtue of the rejection of the stay, the respondent No.4 is trying to take steps to vacate the

petitioner from the subject land. This court on 14.08.2019 while ordering notice before admission granted interim order directing the respondents not to dispossess the petitioner from the subject land and the same is continuing till date.

5. A perusal of the record would reveal that the revision petition filed by the petitioner is pending before respondent No.1.

6. In view of the pendency of statutory revision, without going into the merits of the case, this writ petition is disposed of directing respondent No.1 to dispose of the revision petition filed by the petitioner within a period of four months from the date of receipt of the copy of this order after giving opportunity to the petitioner as well as respondents in the revision petition in accordance with law. Till such time the official respondents are directed not to take any coercive steps against the petitioner.
