B.Venkateswara Reddy v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.28458 of 2015
ORDER
Challenging the inaction of respondents 1 to 4 in registering crime and providing adequate protection to life of the petitioner and his landed property, the present writ petition is filed. It is the case of the petitioner that he lodged a complaint on 17.11.2014, followed by a notice dated 8.5.2015, and in spite of the same, no action was taken by the police.
The 2nd respondent filed counter-affidavit stating that the complaint of the petitioner was received by post and thereafter, he did not approach the police except issuing a notice dated 8.5.2015 through his counsel.
Even if the complaint is received by post, the 2nd respondent ought to have taken prompt action thereon.
Keeping in view the fact that the 2nd respondent has not taken any action on the complaint dated 17.11.2014, and in view of long lapse of time, the petitioner is at liberty to lodge a fresh complaint in the event of any offence committed by any person. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
