THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4918 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioners/Accused Nos.1, 2 and 5 for grant of anticipatory bail in the event of their arrest in connection with Crime No.73 of 2019 of Basheerabad Police Station, Vikarabad, registered for the offence punishable under Section 324 read with 34 I.P.C. 2.

Heard learned counsel for the petitioners/Accused Nos.1, 2 and 5 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

The allegation in the complaint would go to show that the complainant is running cell phone shop in the rented premises of accused No.1. Accused No.1 with an intention to vacate the complainant from the subject premises, he along with other accused attacked the complainant, beat him and caused grievous injuries to him and thereby committed the offence. 4.

Learned counsel for the petitioners/accused Nos.1, 2 and 5 would submit that petitioner No.1 has given the shop lease to complainant and when petitioner No.1 requested the complainant to vacate the shop, the complainant bore grudge on accused No.1 and his friends and lodged the present complaint; that the petitioners have not committed the alleged offence; that the entire investigation is completed in the case, except filing of the charge sheet and hence, he prays to grant bail to the petitioners.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioners/accused Nos.1, 2 and 5. 6.

As seen from the contents of the First Information Report, there are allegations against the petitioners. Therefore, looking into the nature of the allegations and the gravity of offence alleged against the petitioners, I am not inclined to grant bail to the petitioners. However, if the petitioners/accused Nos.1, 2 and 5 surrenders before the Court concerned within ten (10) days from today and moves an application, after giving prior notice to the Public Prosecutor, for grant of bail, the same shall be considered by the Court concerned in accordance with law. 7.

With the above direction, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
