No representation for petitioner. Heard the Assistant Government Pleader for Revenue.

The petitioner prays for Mandamus declaring the action of respondent No.3 in trying to issue new caste certificate in favour of respondent No.4 for the purpose of implicating the petitioner in false cases, without cancelling caste certificate No.C/109/01/2017 dated 07.03.2017, as arbitrary and illegal. The petitioner further prays for a consequential direction to respondents not to issue new caste certificate. Without referring to the averments in the writ affidavit, this Court can conclude that the prayer is completely misconceived. Firstly, the petitioner prays for a direction restraining the statutory authorities from discharging their statutory duty or function. Assuming without admitting that effort is underway to issue a caste certificate in favour of 4th respondent, the petitioner is not without remedies under the A.

P (Scheduled Caste, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993. After perusing the record, I am satisfied the writ prayer is misconceived and this Court is not persuaded to exercise its jurisdiction. The writ petition is, accordingly, dismissed. There shall be no order as to costs.
