HON'BLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 in/and CRIMINAL PETITION No.4945 of 2019 O R D E R :
This Criminal Petition under Section 482 of the Code of the Criminal Procedure, 1973, is filed by the petitioner/Accused seeking to quash the proceedings in C.C.No.1242 of 2016 on the file of III Additional Chief Metropolitan Magistrate, Hyderabad.
A charge sheet came to be filed against the petitioner for the offences punishable under Sections 419, 420 and 493 of IPC.
During pendency of the Criminal Petition, I.A.No.2 of 2019 is filed by the petitioner/Accused seeking permission to compound the aforesaid offences; and I.A.No.3 of 2019 is filed by respondent No.2/defacto complainant seeking to record compromise between the petitioner/Accused and respondent No.2/defacto complainant in C.C.No.1242 of 2016. The said Compromise Petition has been duly signed by the petitioner/Accused and respondent No.2/defacto complainant and their respective counsel. Along with the petition, a Joint Memo has been filed, inter alia stating that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise. The said Joint Memo has been supported by the affidavit of respondent No.2/defacto complainant.
GSD, J Crl.P.No.4945 of 2019 Today, both the parties are present before this Court and they were identified by their respective counsel. This Court, when examined, both the parties have stated that at the instance of the elders and well wishers, they have settled the matter out of the Court and respondent No.2/defacto complainant has no objection for quashing the proceedings against the petitioner/Accused.
In the light of the compromise arrived at between the parties, the Compromise Memo filed by both the parties is recorded and I.A.Nos.2 and 3 of 2019 are ordered. Accordingly, this Criminal Petition is allowed in terms of the compromise and the proceedings in C.C.No.1242 of 2016 on the file of III Additional Chief Metropolitan Magistrate, Hyderabad, against the present petitioner/Accused are hereby quashed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
