The present appeal is filed by the appellant/2nd respondent against the judgment and decree dt.31.07.2000 passed in A.S.No.24 of 1993 on the file of the Senior Civil Judge, Peddapuram, setting aside the judgment and decree, dt.28.07.1993 passed in O.S.No.94 of 1988 on the file of the Principal District Munsif, Peddapuram.

It is represented by the learned counsel for the appellant that the sole appellant died.

In view of the above submission, no cause survives in the second appeal.

The second appeal is, therefore, dismissed as abated. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
