ORDER

This Criminal Petition is filed by the petitioner/accused under Section 482 Criminal Procedure Code, seeking to quash the proceedings against him in connection with Crime No.292 of 2022 of Alwal Police Station, Cyberabad, registered for the offence under Sections 420, 504 and 506 of Indian Penal Code. 2.
Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the respondents No.1 - Police. 3.
As per the complaint, the petitioner has taken an amount of Rs.3 lakhs as Rs.2 Lakhs cash, and Rs.1 lakh through googlepay to the account of one Priyanka, D/o. Sudhakar as a token advance towards purchase of the petitioner's house. It is further alleged that thereafter, the said Sudhakar along with his daughter stopped answering the calls of De facto complainant. Further, when the De facto complainant approached the accused, they threatened him with dire consequences.

Sri M.S. Achyuth Bharathwaj, learned Counsel appearing for the petitioner would submit that, the allegations levelled against the petitioner are baseless and concocted and prayed the Court to quash the proceedings in FIR No.292 of 2022 against the petitioner. 5.
Considering the facts and circumstances of the case, this petition is disposed off directing the Investigating Officer in Crime No.292/2022 pending on the file of Alwal Police Station, Cyberabad, to strictly follow the procedure laid down under Section 41-A Cr.P.C. and also the guidelines issued by the Apex Court in Arnesh Kumar Vs.State of Bihar1.

As a sequel, the miscellaneous Petitions, pending if any, shall stand closed.
