THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL REVISION CASE No.1601 of 2013 ORDER:
This Criminal Revision Case is filed against the orders of the learned Judicial
Magistrate of First Class, Nandyal, dated 27.05.2013 in Crl.MP.No.1013 of 2013 in C.R.No.160 of 2012, by and under which, the petition filed by the respondent/A4 for giving interim custody of vehicle bearing No.TL09 AY 0846 and Nokia C3 Cell Phone was allowed.
2. Heard the learned Additional Public Prosecutor, representing the State.
3. The learned Additional Public Prosecutor submits that giving the interim custody of the vehicle, which is involved in serious offence, is not proper.
4. Perused the impugned order. On being satisfied that the respondent/A4 is the registered owner of the vehicle, the learned Magistrate exercised his discretion of giving the vehicle for interim custody to the respondent/A4. Sufficient safeguards have been provided for in the impugned order. There are no merits in the present revision and the same is liable to be dismissed.
5. The Criminal Revision Case is accordingly dismissed. Pending miscellaneous applications, if any, shall stand closed in consequence.
