HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18702 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in not considering the application of the petitioner for providing employment on compassionate grounds, consequent upon the death of her husband, as illegal and arbitrary.

Heard Sri M.V.S. Suresh Kumar, learned counsel for the petitioner and Sri P. Durga Prasad, learned standing counsel for the respondent corporation.

It has been contended by the petitioner that her husband was employed with the respondent and he had expired while discharging duties on 18.09.2002. She had submitted an application to the respondent seeking compassionate appointment, but the respondent had rejected her case vide orders dated 15.02.2003. Challenging the same, she filed the present writ petition.

Learned counsel for the petitioner has contended that though there is a scheme for providing compassionate appointment to the petitioner, the respondent without appreciating the case of the petitioner had mechanically rejected her case. Learned standing counsel for the respondent has submitted that the case of the petitioner will be considered in terms of the latest circulars and regulations of the corporation and appropriate orders will be passed.

This Court having considered the submissions made by the learned counsel on either side is of the considered view that the writ petition can be disposed of directing the respondent to consider the case of the petitioner for compassionate appointment in terms of the latest circulars and regulations of the corporation, within four weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
