HON'BLE SRI JUSTICE DILIP B. BHOSALE CIVIL REVISION PETITION No. 4743 OF 2013 PC:
On 14-11-2013, this Court passed the following order: "Sri M. Papa Reddy accepted notice for the sole respondent. Post on 03.12.2013 for 'admission and hearing'. Pending further orders, there shall be interim stay of all further proceedings pursuant to the order under revision subject to the condition that the admitted monthly rent of Rs.2.5 lakhs is paid regularly."
Thereafter, on 13-02-2015, the following order was passed: "Heard learned counsel for the parties.
Learned Senior Counsel for the petitioner seeks a week's time to take instructions whether the petitioner is ready to deposit rent @ Rs.3.5 Lakhs per month and for disposal of this C.R.P with direction to the trial Court to dispose of the suit itself within time frame. Stand over to 20-02-2015.
It is needless to mention that the trial Court need not stay the further proceedings and it is desirable to proceed with the trial." In view of the order dated 13-02-2015, in my opinion, the order granting stay of further proceedings dated 14-11-2013 stood vacated. As a matter of fact, learned Senior Counsel for the petitioner submits that the petitioner is also ready to proceed with the hearing of suit.
Keeping that in view and considering the orders dated 14-11-2013 and 13-02-2015, learned counsel for the parties have agreed for disposal of the C.R.P by the following order:
"The petitioner shall deposit a rent of Rs.3.5 Lakhs per month from April, 2015 without prejudice to their rights and contentions in the suit. The trial Court shall dispose of the suit as expeditiously as possible, and preferably within a period of eight months from today. The parties are directed to co-operate for disposal of the suit within the time frame. The petitioner is directed to produce a copy of this order before the Court below on or before 30-04-2015." With these observations, the C.R.P is disposed of. Miscellaneous petitions, if any, also stand disposed of. ______________________ DILIP B. BHOSALE, J 24-04-2015 ks
