ORDER:
This contempt case is filed alleging wilful disobedience of order dt.25.7.2014, in C.M.A. M.P. No.885 of 2014 in C.M.A. No.586 of 2014. The petitioners alleged that despite the undertaking given to this Court by the counsel for the respondents that his clients have not been proposing any construction over the cellar area, they have raised a construction over the said cellar area.
Mr. M.D. Mohapatra, learned counsel for the petitioners, however, fairly conceded that his clients have not issued any notice to the respondents before filing this case. The contempt proceedings being quasi criminal in nature, the party alleging violation of order by the opposite party, cannot invoke contempt jurisdiction unless he/she has put the respondents on notice of violation of the order of this Court. In this view of the matter, the contempt case is dismissed with liberty to the petitioners to file a fresh case after notice to the respondents. _______________________ C.V.
