ORDER
The learned counsel for the petitioner/Accused No.4 seeks permission of this court to withdraw the criminal petition and to file an application under Section 767 of Cr.P.C. on completion of statutory period before the concerned Court.
2. Accordingly, permission is granted for withdrawal of the Criminal Petition, however, in the event of the petitioner filing an application under Section 167 Cr,P.C. seeking mandatory bail, the same shall be disposed of by the concerned Court on the very same day.

Hence, the Criminal Petition is dismissed as withdrawn" 4.
