HON'BLE MRS. JUSTICE ANIS A.S.M.P.NOS.1332 OF 2017 AND APPEAL SUIT No.575 of 2007 COMMON JUDGMENT:

A.S.M.P.No.1332 of is filed by the appellant/plaintiff along with memorandum of compromise to record compromise and pass a decree in terms of the conditions of memorandum of compromise.

Appellant, 1st respondent and counsel appearing on their behalf are present and they are identified by each other and respective counsel appearing on their behalf. It is represented that 2nd respondent is not present and she filed Special Vakalat through her counsel viz., J.Bhaskara Rao to appear and record the compromise on her behalf. The said Special Vakalat is placed on record.

The contents of the compromise are read over to both the parties.

Both parties agreed voluntarily for the compromise as per the terms and conditions of the memorandum of compromise.

Therefore, in view of the compromise entered into both the parties, A.S.M.P No.1332 of 2017 is allowed.

Accordingly, the Appeal Suit is allowed in terms of the memorandum of the compromise. However, it is made clear that this compromise relates only to the subject matter of the suit and appeal. No order as to costs. Miscellaneous Petitions, if any, pending in this Appeal Suit shall stand closed. _________ ANIS, J 10.07.2017 TSNR
