THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.5037 of 2015 ORDER:

The petitioner is stated to be an unemployed person. The respondents issued notification No.01/2013 to fill up the vacancy of Junior Estates Officer. The petitioner applied for the same and attended the written examination and oral interview. He secured 52.52 marks in both written and oral examinations. He belongs to BC-E category. However, the post is reserved for BC-E (Women) category. There is no other candidate belonging to BC-E (W) category and in those circumstances, the petitioner states that he should be given an appointment. He also submitted a representation on 05.12.2014 for the said purpose. When the same was not considered, the present writ petition is filed.

2. Since it is an admitted case that the post of Junior Estates Officer to which the petitioner applied was earmarked for BC-E (W), the said condition cannot be varied by this Court, merely because the women candidates are not available. In view of representation submitted by the petitioner on 05.12.2014 to the respondents, this Court does not express any opinion on the merits of the case, but gives liberty to the respondents to consider the said representation and dispose of the same in accordance with law within a period of three

(03) months from the date of receipt of a copy of this order.

3. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
