HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15135 of 2018 ORDER: (Oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 14th March 2018, passed in O.A.No.474 of 2018 by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby, the application filed under Section 19 of the Administrative Tribunals Act, 1985 has been dismissed.

In para 5 of the impugned order, the learned Tribunal has observed as under :

"It is to be seen that the applicant was convicted by the competent criminal Court to undergo imprisonment for a period of six months and on appeal, the said conviction was confirmed and in the Criminal Revision before the Hon'ble High Court, only sentence was suspended. By that time, the applicant was already in prison for more than 10 days and the conviction is staring at him. The applicant is lucky that he is only placed under suspension and the respondents have not resorted to other provisions under APCS (CC&A) Rules, 1991."

In view of the above observations made by the Tribunal, we find no ground to interfere with the impugned order. 4.

Finding no merit in the writ petition, the same is accordingly dismissed. No order as to costs.
